1.       Company organizing the Contest

PALLADIUM GESTIÓN, S.L.U., with registered office on Avda. de Bartolomé Roselló, 18; 07800 Ibiza, Balearic Islands (Spain), with Tax Identification Number B-16.652.760 (hereinafter “Palladium”) is organizing a contest called CARIBBEAN EXPERIENCE - NY ISLANDERS (hereinafter the “Contest”) subject to the these rules, in order to reward the loyalty of the members of the loyalty program known as Palladium Rewards, a program that rewards the stays and purchases made by its members in hotel establishments managed of Palladium or its business group, by awarding points that can be exchanged for stays and consumption in such establishments (the “Program”).

2.       Duration, requirements and mechanics of the Contest

The Contest will run for the period from 00:01 a.m. on April 09, 2024 to 12:00 midnight on May 09, 2024 (CET - Central European Time) (“Contest Duration Period”).

To participate in the Contest, all you need to do is register in the Program. All members already registered in the Program at the time the Contest is announced, as well as all those who register after the Contest is announced with the sole intention of participating in the Contest, are eligible to participate.

To participate, you simply need to express your desire to take part:

-          Users not registered in the Program need only click on the “PARTICIPATE” button that they will find on the New York Islanders website www.nhl.com/islanders/, in the email that will be sent to the New York Islanders database or in the Social Media publication announcing the draw. From this button you will be taken to the Palladium Rewards registration form and will have to complete your registration in the Program using the promotional code ISLES.

-          Users already enrolled in the Program simply need to send an email to promociones.rewards@palladiumhotelgroup.com expressing their desire to participate in the Contest.

3.       Drawing the winners

During the Contest Duration Period:

-          The Salesforce platform will register all the participants of each day who have not been registered in the Program so far and who have registered with the promotional code ISLES.

-          The inbox of the email address promociones.rewards@palladiumhotelgroup.com, will register all the participants of each day, who have already registered in the Program before the announcement of the Contest and have expressed their desire to participate in it.

On May 9, 2024, the entries collected through the Salesforce platform and the promociones.rewards@palladiumhotelgroup.com email account inbox will be combined to create a single list of participants registered on the Easy Promo platform, through which a drawing will be held to determine one (1) winner and five (5) runners-up (the “Draw“).

Within no more than one (1) calendar day from the date of the Draw, Palladium will contact the winner at the email address listed in the Program’s database to notify the winner of the result.

If the winner does not respond to the email within three (3) calendar days, the first runner-up will be awarded the prize.

The foregoing will apply mutatis mutandis if the first runner -up and/or subsequent runners-up do not respond within the indicated term.

4.       Prize – General Conditions

The winning participant, according to the records reported by the easypromosapp platform, will be awarded 250,000 Rewards points which will be added to their Palladium Rewards account within a period of no more than (5) calendar days from the date of the winner's response to notification of the prize and can be redeemed for a stay, catering services or spa services at any of the Palladium Hotel Group hotels participating in the Program within 6 months (the “Prize”).

If the winner has left the Program (i) before being notified of being named winner or (ii) before the Prize Transfer Deadline, the Prize will be transferred to the next person in line according to the records reported by the easypromosapp platform, and if that person has left the Program before the deadlines described in points (i) and (ii), the Prize will be transferred to the next runner-up, and so on and so forth. This process will also be applicable if there is any error in the data provided by the winning participant that prevents them from being identified or localized.

5.       Reservations and limitations

Palladium will not be liable in the event that there are any errors in the data provided by the participants which may prevent them from being identified or located if they are named as winners.

Palladium will not be liable for any damages of any kind that may result from the lack of availability or continuity of the supports that enable participation in the Contest and/or allow its development and/or completion, including the holding of the Draw, including but not limited to problems accessing the online systems and platforms used for this purpose.

Palladium reserves the right to disqualify for cause any participant who tampers with, alters or disrupts the proper operation and normal course and rules of the Program and/or the Contest.

Palladium reserves the right to shorten, delay, modify or cancel the Contest in the event of extraordinary circumstances that prevent the Contest from being held or continued, and will notify Participants of such action.

Palladium is not responsible for any force majeure that may prevent the winner from enjoying all or part of the Prize.

The winner and all entrants, as a condition of entry into the Contest, agrees to release New York Arena Partners, LLC, New York Islanders Hockey Club, L.P., OVG Belmont Facilities, LLC, the New York State Urban Development Corporation d/b/a Empire State Development and the NHL Entities, and each of their respective parents, affiliates, subsidiaries and their respective shareholders, partners, members, directors, officers, employees and agents, and each of the foregoing’s respective affiliates (collectively, the “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries (including as a result of the novel COVID-19 virus), damages, or losses to persons or property which may be sustained in connection with participating in any aspect of the Contest, the receipt, ownership or use of the prize awarded, or any typographical or other error in these rules. “NHL Entities” means the National Hockey League (“NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC, any entity that may be formed by the NHL member clubs, and each of their respective affiliates and subsidiaries. The Released Parties are each not a sponsor of the Contest, and are in no way responsible for the administration of the Contest, the verification of winners or the fulfillment of prizing.

6.       Data protection

In line with the provisions of the valid regulations on personal data protection, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR) and Organic Law 3/2018 of December 5 on the Protection of Personal Data and guarantee of digital rights, participants of the Draw are hereby informed that their data will be processed by Palladium Gestión, S.L.U. as data controller, registered office Avda. Bartolomé Roselló, 18, Ibiza, Balearic Islands, Spain.

The data of the participants will be the identification data necessary to participate in the Contest.

The purpose of data processing is the management of the Contest, as well as the publication of the winner or, where appropriate, the runners-up and the processing of the delivery of the Prize. The lawful basis is the express acceptance of these rules for the participation of the data subject party in the Contest.

Their data will not be provided to third parties except when legally obliged to by:

·                the State Tax Administration Agency to fulfill tax obligations related to the Contest, if applicable,

·                the administrative authorities that might require it within the framework of compliance with the legal obligations of the data controller or within the framework of any proceedings that may be opened by them in relation to participant claims, or

·                the competent legal authorities.

Participants’ data will be retained for the duration of this Contest. They will be blocked for the legally established period to meet the requirements of any possible claims.

The data of the winner, including those whose entries are ultimately unsuccessful, will also be kept for the time necessary to manage the delivery of the Prize, the publication of the results of the Draw and to comply with the legal, tax and administrative requirements related to the Contest. Afterwards, they will be blocked for the legally required periods for possible tax and administrative liabilities, as well as legal actions that might derive from them and the promotion.

Participants may exercise their rights to access, rectification, erasure, restriction on processing, data portability, and, if appropriate, objection, as well as revoke the consent granted.

To exercise these rights, you must send a written request, specifying the rights you wish to exercise, to the postal address above or to the email address rgpd@palladiumhotelgroup.com. If there is reasonable doubt about your identity, you may be asked to provide additional information in order to exercise your rights.

If you believe that your right to personal data protection has been violated, you may contact our Data Protection Officer at dpo@palladiumhotelgroup.com, or file a complaint with the competent Data Protection Supervisory Authority.

7.       Acceptance of the terms and conditions

The participant accepts these rules in advance by expressly agreeing to participate in the Contest.

8.       Deadline for claims

Any claim related to the Contest and these rules must be submitted within thirty (30) calendar days of the Prize Transfer Deadline. No claim whatsoever related to this matter will be accepted after that.

9.       Law and jurisdiction

These terms and conditions are governed by Spanish common law. For any concern that may arise regarding their interpretation, the parties submit themselves to the jurisdiction of the courts and tribunals of the city of Ibiza, Balearic Islands, Spain, expressly waiving any other jurisdictional privilege to which they may be entitled.
